These Terms and Conditions set out the basis on which Rubbish Removal Greenwich provides rubbish removal, waste collection and related services. By making a booking, confirming a quotation, or allowing our team to commence work at your premises, you agree to be bound by these Terms and Conditions.
1. Definitions and Interpretation
In these Terms and Conditions, the following words shall have the meanings set out below:
Customer means the person, business, company or organisation requesting and paying for the services.
Services means any rubbish removal, waste clearance, waste collection, loading, transportation, recycling, disposal or related services provided by us.
Waste means any items, materials, rubbish, refuse, junk or other matter that the Customer asks us to remove, whether domestic, commercial or mixed waste.
Quotation means the price estimate we provide for the requested services, based on the information supplied by the Customer.
Premises means the property, land, building, site, access road or location where the services are to be carried out.
We, us and our mean Rubbish Removal Greenwich.
2. Scope of Services
We provide waste collection and rubbish removal services for domestic and commercial customers. This may include house, flat, office, garden, builders and general rubbish clearances, subject to waste regulations and these Terms and Conditions.
All services are subject to availability, suitable access, safety considerations, and the nature and volume of waste to be collected. We reserve the right to decline or amend any booking if, on arrival, the waste or access conditions differ materially from those described at the time of booking.
3. Booking Process
3.1 Bookings can be made by telephone, email or other communication methods we may make available. At the time of booking, the Customer must provide accurate information about:
a. The location of the premises.
b. The type of waste to be removed.
c. The approximate volume or quantity of waste.
d. Access restrictions, parking arrangements and any special requirements.
3.2 Quotations are typically provided based on the Customer s description of the waste and any photographs or information supplied. The final price may be adjusted on site if the actual waste volume, weight or type differs from the description.
3.3 A booking is only confirmed when we have accepted the Customer s request, provided a quotation and either:
a. The Customer has accepted the quotation and we have scheduled a collection time; or
b. A deposit or pre-payment has been received, where required.
3.4 We will use reasonable efforts to attend the premises during the agreed time window. However, all times are estimates and may be affected by traffic, delays at other jobs, or unforeseen circumstances. We accept no liability for losses arising from delays or rescheduling, but will notify the Customer where possible if significant delays occur.
4. Access and Customer Obligations
4.1 The Customer is responsible for ensuring that:
a. We have safe and reasonable access to the premises and the waste.
b. Any necessary parking permissions, visitor permits or loading arrangements are in place.
c. The waste to be collected is clearly identified and separated where necessary.
d. Any relevant third parties, such as landlords or building managers, have given permission for the services to be carried out.
4.2 If we are unable to complete the work due to lack of access, incorrect information or other reasons within the Customer s control, we may charge a call-out fee or a reasonable proportion of the quoted price to cover our costs.
5. Pricing, Quotations and Changes
5.1 Unless otherwise stated, prices are quoted inclusive of transport, labour and standard disposal fees for non-hazardous waste.
5.2 Quotations are based on the information supplied by the Customer. If on arrival we find that:
a. The volume or weight of waste is greater than described; or
b. The waste includes items that are more costly to dispose of; or
c. Additional labour, time or equipment is required beyond what could reasonably be anticipated;
then we may revise the quotation. The Customer will be informed of any change in price before the work continues.
5.3 If the Customer does not accept a revised price, we are entitled to decline or curtail the service. In such cases, a reasonable attendance or call-out charge may be applied to cover time and transport costs.
6. Payments and Invoicing
6.1 Payment terms will be confirmed at the time of booking. Unless otherwise agreed in writing:
a. Domestic customers are required to pay on completion of the service.
b. Commercial customers may be invoiced, with payment due within the period specified on the invoice.
6.2 We accept approved payment methods, which may include cash, bank transfer, card payment or other methods notified to the Customer.
6.3 All amounts payable under these Terms and Conditions must be paid in full, without set-off, deduction or counterclaim.
6.4 If any payment is not made by the due date, we reserve the right to charge interest on the overdue amount at the statutory rate applicable to commercial debts, and to recover any reasonable costs incurred in pursuing payment.
7. Cancellations, Rescheduling and Waiting Time
7.1 The Customer may cancel or reschedule a booking by contacting us as soon as possible. Any cancellation or change is effective only when acknowledged by us.
7.2 We reserve the right to apply a cancellation fee if:
a. The booking is cancelled or significantly changed with less than 24 hours notice before the agreed time; or
b. Our team arrives at the premises but is unable to carry out the work due to reasons within the Customer s control.
7.3 Where our team is kept waiting beyond a reasonable period due to lack of access, incomplete preparation or other factors within the Customer s control, we may charge waiting time at our standard rates.
7.4 We may cancel or reschedule a booking due to safety concerns, severe weather, access problems, vehicle breakdown, staff illness or other events beyond our reasonable control. In such cases, our liability is limited to rescheduling the service or refunding any pre-payment received for the affected booking.
8. Waste Regulations and Prohibited Items
8.1 We operate in accordance with applicable waste management legislation and regulations in the United Kingdom. The Customer confirms that they have the right to authorise removal of the waste and that the waste is not stolen or unlawfully obtained.
8.2 We do not collect certain hazardous or prohibited items except by prior written agreement and subject to additional charges and compliance requirements. Such items may include but are not limited to:
a. Asbestos or materials containing asbestos.
b. Clinical and medical waste.
c. Corrosive, explosive, toxic or flammable substances.
d. Gas cylinders and some pressure vessels.
e. Chemicals, oils, paints or solvents in unsuitable containers.
f. Radioactive materials.
8.3 If we discover on arrival that the waste includes prohibited or hazardous items that were not disclosed at the time of booking, we may:
a. Refuse to remove such items.
b. Revise the quotation to include the additional cost and regulatory requirements of handling them; or
c. Cancel the service and charge a reasonable attendance fee.
8.4 The Customer shall not knowingly conceal hazardous waste within general rubbish. The Customer will be responsible for any fines, claims, losses or costs arising from undeclared hazardous or prohibited items included in the waste.
9. Title and Responsibility for Waste
9.1 Ownership of waste transfers from the Customer to us only when the waste has been loaded onto our vehicle and payment terms have been satisfied or agreed. Before that point, the waste remains the responsibility of the Customer.
9.2 Once the waste has been collected and payment received or agreed, we accept responsibility for its lawful transport, treatment and disposal in accordance with applicable regulations.
10. Damage, Liability and Insurance
10.1 We will exercise reasonable skill and care in providing the services. However, minor scuffs or marks may occur when moving bulky items through tight spaces, doorways or stairwells. The Customer should take precautions to protect flooring, walls and fixtures where necessary.
10.2 We shall not be liable for:
a. Any pre-existing damage to property, fixtures, fittings or belongings.
b. Damage arising from inherent defects, poor construction, or fragile items that are not reasonably suitable for moving.
c. Loss or damage caused by inaccurate instructions, insufficient information or acts or omissions of the Customer or third parties.
10.3 If we are found liable for loss or damage, our liability shall, to the maximum extent permitted by law, be limited to the lesser of:
a. The total price paid or payable for the relevant service; or
b. The reasonable cost of repairing the damaged item or area, or replacing the item on a like-for-like basis, subject to fair wear and tear and depreciation.
10.4 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot lawfully be excluded under English law.
11. Customer s Goods and Personal Items
11.1 The Customer is responsible for ensuring that no personal belongings, valuable items or important documents are left in items or containers intended for removal.
11.2 We accept no responsibility for the loss of any items that are removed as waste, provided we have acted in accordance with the Customer s instructions and the items were not clearly and obviously separate from the waste to be collected.
12. Complaints
12.1 If the Customer has any concerns or complaints about our services, they should contact us as soon as possible, providing full details of the issue and any supporting information.
12.2 We will investigate complaints in a fair and timely manner and, where appropriate, propose a suitable solution which may include rectification of the issue, a partial refund or other reasonable remedy.
13. Events Beyond Our Control
13.1 We shall not be in breach of these Terms and Conditions or otherwise liable for any failure or delay in performing our obligations where such failure or delay results from events, circumstances or causes beyond our reasonable control. These may include, without limitation, extreme weather, accidents, road closures, strikes, public disturbances, equipment failure, or restrictions imposed by authorities.
13.2 In such circumstances, we may suspend or reschedule the affected services. If services cannot reasonably be performed, we may cancel the booking and refund any sums paid for services not delivered.
14. Data Protection and Privacy
14.1 We may collect and process personal information about the Customer for the purposes of managing bookings, providing services, handling payments, and complying with legal obligations.
14.2 We will take reasonable steps to keep personal information secure and will not sell or share it with unrelated third parties except where required for the performance of our services, collection of debts, or compliance with law.
15. Variation of Terms
15.1 We reserve the right to amend these Terms and Conditions from time to time. The version in force at the time of the Customer s booking will apply to that booking.
15.2 Any variation to these Terms and Conditions requested by the Customer shall be ineffective unless agreed in writing by us.
16. Severability
16.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
17. Governing Law and Jurisdiction
17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the provision of our services, shall be governed by and construed in accordance with the laws of England and Wales.
17.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
18. Entire Agreement
18.1 These Terms and Conditions, together with any written quotation or confirmation issued by us, constitute the entire agreement between the Customer and Rubbish Removal Greenwich in relation to the provision of waste collection and rubbish removal services.
18.2 The Customer acknowledges that they have not relied on any statement, promise or representation that is not expressly set out in these Terms and Conditions or confirmed in writing.
By placing a booking or permitting our team to commence work, the Customer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
